LEGAL ISSUE
K-9 sniffing is not a 4th Amendment issue. Courts have determined that there is not a reasonable expectation of privacy in the air space surrounding an object. This is referred to as Public Smell Doctrine and is associated to the Doctrine of Plain View which are both outside of the 4th Amendment protection.

This act requires schools to provide and maintain a safe environment. Federal and State funds have been made available to do this. Shouldn’t the most effective and efficient means of detection be used?
WORKPLACE - DRUG FREE WORKPLACE ACT OF 1988
This requires many businesses to implement procedures to ensure safe work environments. Also, the FEDERAL REHABILITATION ACT OF 1973 says you cannot discriminate against former substance abusers and labels them handicapped. Furthermore, employees can sue employers for not maintaining a safe environment if they are injured physically or mentally.
